WHEREAS section 3 of the Conservation Lands Act, R.S.O. 1990, c. C.28 and paragraph 11(2)6 of the Municipal Act, 2001, S.O. 2001, c. 25 and in furtherance of Minutes of Settlement between the parties dated December 12, 2008 pursuant to OMB PL040510,  the municipality is authorized to enter into the agreement thereunder;
 
AND WHEREAS Council of the Corporation of the Town of Collingwood enacted and passed By-law No. 2010-069, a by-law to authorize the execution of an agreement between 2079409 Ontario Inc., the Corporation of the Town of Collingwood and Bass Bay Cottagers Corporation pertaining to property municipally addressed as 80 Madeline Drive;
 
AND WHEREAS on August 11, 2014 Council passed a resolution to grant an exemption to the payment of parkland dedication fees applicable to 80 Madeline Drive, as set out in Section 42(1) of the Planning Act, R.S.O. 1990, c. P. 13, as amended, the Town’s Parkland Dedication By-law No. 04-63 and as previously negotiated in the Ontario Municipal Board Minutes of Settlement;
 
AND WHEREAS Council deems it necessary to enter into an amending Agreement to reflect the exemption granted by Resolution No. 334 (2014);
 
NOW THEREFORE COUNCIL OF THE CORPORATION OF THE TOWN OF COLLINGWOOD ENACTS AS FOLLOWS:
 
1.       THAT the Mayor and Clerk be hereby authorized to execute the Second Amending Agreement, affixed hereto, between 2079409 Ontario Inc., the Corporation of the Town of Collingwood and Speck Consulting Inc. for property municipally addressed as 80 Madeline Drive to implement the exemption granted by Resolution No. 334 (2014):
 
“BE IT RESOLVED THAT Council hereby grant an exemption to the payment of parkland dedication fees applicable to 80 Madeline Drive, as set out in Section 42(1) of the Planning Act, R.S.O. 1990, c. P. 13, as amended, the Town’s Parkland Dedication By-law No. 04-63 and as previously negotiated in the Ontario Municipal Board Minutes of Settlement;
 
AND FURTHER THAT the property owner be responsible for the necessary amendments to the Development Agreement applicable to the property be amended to recognize the waiving of the parkland dedication fee.”
 
2.  THAT this By-law shall come into full force and effect on the date of final passage hereof at which time all By-laws and/or resolutions that are inconsistent with the provisions of this By-law and the same are hereby repealed or rescinded insofar as it is necessary to give effect to the provisions of this By-law.
 
ENACTED AND PASSED this 8th day of September, 2014.
