BEING A BY-LAW TO ESTABLISH A CODE OF CONDUCT FOR MEMBERS OF COUNCIL AND COMPLAINT PROTOCOL

WHEREAS Section 11 of the Municipal Act 2001, S.O. 2001, c. 25, as amended, authorizes municipalities to pass by-laws regarding Accountability and Transparency of the municipality and its operations and of its local boards and their operations;
AND WHEREAS section 223.2 of the Municipal Act 2001, S.O. 2001, c 25, authorizes the municipality to establish codes of conduct for members of council of the municipality and of local boards of the municipality;
AND WHEREAS Council enacted by resolution a Code of Ethics for members of Council, later defined as a Code of Conduct;
AND WHEREAS an Integrity Commissioner was appointed by By-law No. 2013-107 for the purposes of investigating alleged transgressions or breach of the Municipal Code of Conduct adopted by Council;
AND WHEREAS a review of the current Code of Conduct enacted by By-law No. 2014-042 was undertaken to establish a Code of Conduct that incorporates members of Council as well as Local Boards and Committee Members;
AND WHEREAS Council deems it necessary to repeal By-law No. 2014-042 to enact the Code of Conduct for Members of Council, Local Boards and Committee Members;
NOW THEREFORE COUNCIL OF THE CORPORATION OF THE TOWN OF COLLINGWOOD ENACTS AS FOLLOWS:
THAT the Council of the Town of Collingwood does hereby adopt the Code of Conduct, attached hereto as Schedule “A”, forming part of this by-law.
THAT the Integrity Commissioner and/or Clerk be authorized to make minor amendments to Schedule “A” as may be appropriate from time to time.
THAT By-law No. 2014-042 be hereby repealed.
THAT this By-law shall come into full force and effect on the date of final passage hereof at which time all By-laws and/or resolutions that are inconsistent with the provisions of this By-law and the same are hereby repealed or rescinded insofar as it is necessary to give effect to the provisions of this By-law.
