WHEREAS By-law No. 90-77 designated 291 Third Street as having architectural and historical significance;
 
AND WHEREAS section 30.1(1) of the Ontario Heritage Act, R.S.O., 1990 c. O.18, as amended, authorizes the council of a municipality to amend a by-law to clarify or correct the statement explaining the property’s cultural heritage value or interest or the description of the property’s heritage attributes;  
 
AND WHEREAS the Council of the Corporation of the Town of Collingwood (the “Town”) has caused to be served on the owners of the lands legally described as the part of Lots 28, 29, and 30, east side, Cedar Street, Plan 38 AKA Plan 73; now Parts 4, 5, and 6, Plan 51R-38025 and known municipally as 291 Third Street in the Town of Collingwood and upon the Ontario Heritage Trust, Notice of the Proposed Amendment of the aforesaid real property;  
 
AND WHEREAS the Statement of Cultural Heritage Value or Interest and the Description of Heritage Attributes are set out in Schedule “B” attached hereto;
 
AND WHEREAS no Notice of Objection to the proposed designation has been served on the Clerk of the Town;
 
AND WHEREAS this By-law is to be registered in the proper Land Registry Office with respect the property described in Schedule “A” attached hereto;
 
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF COLLINGWOOD HEREBY ENACTS AS FOLLOWS:
 
1.    THAT By-law No. 90-77 be hereby amended to include Schedule “A” and Schedule “B” as attached hereto to provide the full legal description and Statement of Cultural Heritage Value or Interest for the real property known legally as the part of Lots 28, 29, and 30, east side, Cedar Street, Plan 38 AKA Plan 73; now Parts 4, 5, and 6, Plan 51R-38025 and is known municipally as 291 Third Street;
 
2.    THAT the Clerk is hereby authorized to cause a copy of the By-law to be served on the owner of the aforesaid property and on the Ontario Heritage Trust and to cause notice of the passing of this By-law;
 
3.    THAT this By-law shall come into full force and effect on the date of final passage hereof at which time all By-laws that are inconsistent with the provisions of this By-law and the same are hereby repealed insofar as it is necessary to give effect to the provisions of this By-law.
