Amend Parking By-law (Large vehicles/trailers)

Summary: 

BEING A BY-LAW TO AMEND BY-LAW NO. 03-62 FOR THE REGULATION OF PARKING WITHIN THE TOWN OF COLLINGWOOD


WHEREAS Section 11(3)(1) of the Municipal Act, 2001, S.O. 2001, c. 25 as amended (the Act), provides Council the authority to enact by-laws to regulate parking and traffic subject to the Highway Traffic Act;
 
AND WHEREAS Section 11(3)(8) of the Act provides Council the authority to enact by-laws to regulate parking in areas other than highways;
 
AND WHEREAS Council deems it expedient to amend By-law No. 03-62;
 
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF COLLINGWOOD HEREBY ENACTS AS FOLLOWS:
 
1.    THAT Part I – Definitions, of By-law No. 03-62 be amended to include or replace the following:
 
“Trailer” means a vehicle without its own means of propulsion that has to be drawn upon a highway by a motor vehicle;
 
“Large Vehicle” shall mean any motor vehicle having an overall height greater than 3.2 meters or overall length greater than 7.5 meters, with external attachments to the vehicle included in the measurement of height and length;
 
“Street or Highway” includes a common and public highway, street, avenue, boulevard, parkway, driveway, square, place, bridge, viaduct or trestle, any part of which is intended for or used by the general public for the passage of vehicles and includes the area between the lateral property lines thereof;
 
“Unlicensed Vehicle” means a vehicle that does not have a number plate displayed or does not have current validation of a vehicle permit affixed to the number plate, in the manner prescribed in the Highway Traffic Act, as amended.
 
2.   THAT Part III – Parking Prohibited, of By-law No. 03-62 be amended to include:
(B) In Specified Places Where Authorized Signs are on Display, no person shall park a vehicle in any of the following places:
 
(5)  Within 20 meters of the termination of a dead end street, unless the street contains a permanent cul-de-sac.
 
3.    THAT Part III – Parking Prohibited, of By-law No. 03-62 be amended to include:
 
(A) In Specific Places
 
(1)  No person shall,
qq)park or leave a large vehicle or a trailer on a street in front of or adjacent to a residential zone unless it is at the time being used to make a delivery or to provide a temporary service.
rr)   park or leave an unattached trailer of any kind on a street.
ss)  park or leave a vehicle on a Town street or in a municipal parking lot or on any other municipal property which is inoperative or unroadworthy or unlicensed, unless otherwise permitted in this by-law.
 
4.    THAT Part III – Parking Prohibited, of By-law No. 03-62 be amended to include:
 
(G) Where authorized signs are erected and on display to indicate a stopping prohibition, no person shall stop a vehicle in any of the following places:
 
(1)  Within 30 metres on the approach side of any school cross walk and 15 metres on the trailing side of any school cross walk.
 
5.    THAT sub-section (A)(5) of Part III – Parking Prohibited of By-law No. 03-62, be amended to (A)(6) for the following provision:
 
(A)  In Specified Places
           
(5)(6)  The parking of a Bus shall be prohibited on any street north of the Pretty River Parkway between and including Raglan Street to Niagara Street and designated parking areas within Sunset Point Park from the start of the Victoria Day weekend to the end of the Thanksgiving weekend within each calendar year.
 
6.    THAT sub-section (A)(4) of Part III – Parking Prohibited of By-law No. 03-62 be amended to (B)(4) for the following provision:
 
(A)(B) In Specified Places Where Authorized Signs are on Display
           
(4) On a Town of Collingwood Laneway
 
7.  THAT Schedule “A” of By-law No. 03-62 be amended by adding the following:

9.   THAT this By-law shall come into full force and effect on the date of final passage hereof at which time all By-laws and/or resolutions that are inconsistent with the provisions of this By-law and the same are hereby repealed or rescinded insofar as it is necessary to give effect to the provisions of this By-law.
