By-law to Appoint Alternate member to County Council

BY-LAW Number: 


WHEREAS the Municipal Act, 2001, as amended (the “Municipal Act”) provides that the powers of a municipal corporation are to be exercised by its Council through the adoption of by-laws;
AND WHEREAS Section 268 of the Municipal Act authorizes, the council of a local municipality may appoint one of its members as an alternate member of the upper-tier council, to act in place of a person who is a member of the councils of the local municipality and its upper-tier municipality, when the person is unable to attend a meeting of the upper-tier council for any reason;
NOW THEREFORE the Council of The Corporation of the Town of Collingwood hereby enacts as follows:
  1. THAT Council hereby authorize an appointment of an “Alternate Member” to the Corporation of the County of Simcoe Council for a term of the Council that appointed them, or until their appointment by-law is rescinded, or November 30 in the year of a Regular Election, or until such time as the Alternate Member’s seat is declared vacant in accordance with section 259 of the Act.
  2. THAT the appointed Alternate Member shall not sit on behalf of the Mayor or Deputy Mayor at an Inaugural Meeting of County Council.
  3. THAT the Alternate Member be the Councillor receiving the highest votes in the municipal election for that term, unless that member forfeits his/her appointment as an alternate, then it shall be offered to the Councillor with the next highest votes, and so on until the position is accepted, and the respective Council by-law is enacted.
  4. THAT the Alternate Member shall abide by the alternate members policy as may be established by the County of Simcoe, and as may be amended from time to time.
  5. THAT where possible, the alternative member should be provided 48 hours notice regarding the absence of the member, and shall be regularly circulated all agenda material.
  6. THAT the Clerk shall present an appointment by-law to Council of the Town of Collingwood for authorization as soon as practical after the commencement of each Council term.  The appointment by-law once enacted by Council shall be forwarded immediately to the Clerk of the County of Simcoe, as official notice and for the requirement of taking the necessary Oath of Office prior to commencing any duties as an Alternate Member.
  7. THAT this By-law shall come into full force and take effect upon the date of final passing, at which time all by-laws and/or resolutions that are inconsistent with the provisions of this By-law and the same are hereby repealed or rescinded insofar as it is necessary to give effect to the provisions of this By-law.
