Part Lot Control By-law (Pretty River Estates)

Summary: 

BEING A BY-LAW TO EXEMPT A PORTION OF LAND FROM THE PART LOT CONTROL PROVISIONS OF THE PLANNING ACT

WHEREAS Section 50(7) of the Planning Act, R.S.O. c.P. 13, provides that the Council of a local municipality may, by by-law, designate lands not to be subject to part lot control;
 
AND WHEREAS it is intended that three (3) lots for single detached dwellings and one (1) lot for road connectivity purposes be created from Block 179, Registered Plan No. 51M-945;
 
AND WHEREAS the Council of the Town of Collingwood is satisfied that a Development Agreement has been registered (Instrument SC1273511) to address the release and further development of the subject lands; 
 
AND WHEREAS the Council of the Town of Collingwood is satisfied that the three residential lots proposed (identified respectively as Parts 3, 4, Parts 5, 6 and Parts 7,8 on Reference Plan 51R-40241) can be released for development;  
 
AND WHEREAS the Council of the Town of Collingwood is satisfied that the creation of the lots may proceed;
 
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF COLLINGWOOD ENACTS AS FOLLOWS:
 
1. THAT Subsection 5 of Section 50 of the Planning Act, R.S.O. 1990, c.P. 13, shall cease to apply to Block 179, Registered Plan 51M-945, Town of Collingwood, as shown on Schedule “A” affixed hereto.
 
2. THAT this by-law shall remain in force and effect for a period of two (2) years from the date of its passing and shall expire on May 28th, 2020.
