BEING A BY-LAW TO AMEND PROCEDURAL BY-LAW 2006-120

WHEREAS Council has enacted By-law 2006-120 being a by‑law to provide for the rules of order of the Council and its Committees, to provide rules for members’ conduct, and to outline standards for adequate notice;

 
AND WHEREAS Council deems it expedient to further amend By-law 2006-120 with respect to the time and exceptions in which Council and Council – Planning and Development meetings are held, as well as the deletion of Committee of the Whole meetings;
 
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF COLLINGWOOD HEREBY ENACTS AS FOLLOWS:
 
1.          THAT Section 4.5 entitled Regular – time and holiday exceptions of By-law 2006-120 be deleted and replaced as follows:
 
“Following the Inaugural meeting, Regular Meetings shall be held in the Council Chamber of Town Hall on the first, second, fourth and fifth Mondays (when occurring) of each month commencing at 5:00 p.m., except for the month of December, when there shall be one Regular Meeting on the first Monday and the month of July and August, when there shall be Regular Meetings held on the second Monday of those months. When a meeting falls on a Monday that is a Civic or Public Holiday or on a day when Town Hall is closed, the meeting regularly scheduled for that day is deemed to be cancelled unless otherwise approved.”
 
2.          THAT Section 4.8 entitled Committee of the Whole - time of By-law 2006-120 be deleted in its entirety.
 
3.          THAT Section 4.9 entitled Council – Planning and Development - time of By-law 2006-120 be deleted and replaced as follows;
 
““Council – Planning and Development” meetings shall be held the third Monday of the month to address matters pertaining to Planning and Development except for the months of July and August, when there shall be one Council – Planning and Development meeting on the fourth Monday of those months. These meeting will address Planning and Development issues, and shall include but not be limited to public meetings (pursuant to the Planning Act or other applicable legislation), zoning by-law and amendments, official plan and amendments, and to receive and approve development committee minutes/reports, if determined expedient may include provision to meet in-camera in accordance to section 239 of the Municipal Act, 2001. When a meeting falls on a Monday that is a Civic or Public Holiday or on a day when Town Hall is closed, the meeting regularly scheduled for that day is deemed to be cancelled unless otherwise approved.”
 
4.              THAT Section 8.1 entitled Council Agendas – Composition – prepared by Clerk of By-law 2006-120 be deleted and replaced as follows;
 
“Following consultation with the Mayor, the Clerk shall prepare, for the Members of Council, the "Order of Business" as follows:
 
1.    Call to Order
2.    Adoption of Agenda 
3.    Declarations of Conflict or Pecuniary Interest
4.    Adoption of the minutes of the previous meeting(s) of Council
5.    Community Announcements
6.    Deputations
7.    Consent Agenda(s)
8.    Move into Committee of the Whole (if deemed expedient)
9.    Reports/Minutes of Committees/Boards (first Council meeting of the month)
10. Staff Reports
11. Motions
12. By-laws
13. Notice of Motion
14. County Report (first Council meeting of the month)
15. Old or Deferred Business
16. Other Business
17. Confirmatory By-law
18. Adjournment”
 
5.              THAT Section 8.2 entitled Committee of the Whole Agendas – Composition – prepared by Clerk of By-law 2006-120 be deleted in its entirety.
 
6.              THAT Section 17.1 entitled Reports/Minutes – comprised – Advisory Committee of By-law 2006-120 be deleted and replaced as follows;
 
Reports/Minutes of Council established by Advisory Committees and Task Forces shall be listed in the section on the Agenda designated for Committee Reports/Minutes. Committee reports/minutes shall be received and recommendations considered (if any) during the first Council meeting of the month, or added to another regular Council meeting at the direction of the Chief Administrative Office. Recommendations contained in reports/minutes that require Council direction will also be identified on the respective agenda. Development Committee minutes may also be received and recommendations considered at a Council – Planning and Development Meeting.”
 
7.            THAT reference made to the Committee of the Whole in the following sections of By-law 2006-120 be hereby deleted:
 
Section 2.6      Meeting – location – Council Chambers – exception
Section 3.6      Duty of the Chief Administrative Officer
Section 6.2      Agendas – delivered – in advance
Section 6.12    Agenda – Open Session – available – public - exception
Section 6.13    Items – urgent – on Addendum/Addenda
Section 9.0      Commencement of Council/COW/Council – Planning and Development Meetings
Section 10.16 Council – contact – Senior Manager – prior to meeting
Section 12.1    Notice of Motion – filed with Clerk
 
8.            THAT this By-law shall come into full force and effect on the date of final passage hereof at which time all By-laws that are inconsistent with the provisions of this By-law and the same are hereby repealed insofar as it is necessary to give effect to the provisions of this By-law.
 
ENACTED AND PASSED this 14th day of September, 2009.
