WHEREAS Section 34 of the Planning Act, R.S.O. 1990, c. P. 13, as amended, permits the Council of local municipalities to pass Zoning By-laws for prohibiting the use of land or the erection and use of buildings or structures except for such purposes as may be set out in the By-law;
 
AND WHEREAS Zoning By-law No.87-61, as amended, is the governing Zoning By-law for those portions of the Corporation of the Town of Collingwood within the former Town of Collingwood, and said By-law was finally passed by the then Council of the Town of Collingwood on October 26, 1987;
 
AND WHEREAS Zoning By-law No.10-93, as amended, is the governing Zoning By-law for those portions of the Corporation of the Town of Collingwood within the former Township of Nottawasaga, and said By-law was finally passed by the then Council of the Township of Nottawasaga on February 17, 1993;
 
AND WHEREAS Zoning By-law No.10-80, as amended, is an area specific Zoning By-law for those portions of the Corporation of the Town of Collingwood within the former Township of Nottawasaga, and said By-law was finally passed by the then Council of the Township of Nottawasaga on April 30, 1980;
 
AND WHEREAS the Council of the Corporation of the Town of Collingwood has deemed it advisable to repeal the above By-laws, and all amendments thereto, enact this By-Law and thus implement the Official Plan of the Town of Collingwood;
 
AND WHEREAS Council deems that adequate public notice of the public meetings were provided and adequate information regarding this By-law was presented at the public meetings held July 6, 2009 and September 21, 2009, and that a further meeting is not considered necessary in order to proceed with this By-law;
 
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF COLLINGWOOD ENACTS AS FOLLOWS:
  1. THAT Schedule “1” attached hereto forms part of this By-Law.
     
  2. THAT, subject to sections 3 and 4 below,aforesaid By-law Nos. 10-80, 10-93, 87-61, and all amendments thereto, are hereby repealed.
     
  3. THAT the following properties, depicted on Schedule “A” within attached Schedule “1”,shall continue to be subject to the provisions of By-law No. 87-61, as amended, until such time as this By-law is further amended:
    a) 10 Minto Street
    b)  280 Pretty River Parkway
    c)  284 Pretty River Parkway
    d)  290 Pretty River Parkway
    e)  292 Pretty River Parkway
    f)  14 Harbour Street West
     
  4. THAT this By-law shall come into force and effect on the date it is passed by the Council of the Corporation of the Town of Collingwood, subject to the provisions of Section 34 of the Planning Act, R.S.O. 1990, c. P. 13, as amended and Ontario Regulation 545/06. 
ENACTED AND PASSED this 12th day of April, 2010.
