Prohibit Smoking on Sidewalk Patios/Cafes By-law

WHEREAS Section 151 of Municipal Act, 2001, S.O. 2001,c. 25, as amended, provided that a municipality may enact by-laws to license and impose conditions upon any business or class of business;

 

AND WHEREAS By-law No. 03-61, being a by-law to license sidewalk patios/cafes within the Town of Collingwood was passed and enacted on July 14^th, 2003;

 

AND WHEREAS a public meeting was held to receive input prior to imposing an additional condition of license upon sidewalk patios/cafés in the Town of Collingwood, that being to prohibit the smoking on sidewalk patios/cafes within the downtown and this public meeting was duly advertised and conducted in accordance with the Town of Collingwood’s Notice By-law No. 03-12;

 

AND WHEREAS Council deems it expedient to amend By-law No. 03-61 to prohibit the smoking on sidewalk patios/cafes within the downtown through a condition of the patio permit;

 

NOW THEREFORE COUNCIL OF THE CORPORATION OF THE TOWN OF COLLINGWOOD ENACTS AS FOLLOWS:

1)   THAT Section 7 of Schedule “A” of By-law No. 03-61 be amended by adding the following condition:

 

2.   THAT this By-law shall come into full force and effect on the date of final passage hereof at which time all By-laws and/or resolutions that are inconsistent with the provisions of this By-law and the same are hereby repealed or rescinded insofar as it is necessary to give effect to the provisions of this By-law.
