Notice of Passing a Zoning By-law (80 Madeline Drive)

TAKE NOTICE that the Council of the Corporation of the Town of Collingwood passed By-law No. 2010-068 on the 28th day of June, 2010 under Section 34 of the Planning Act, R.S.O. 1990, c. P. 13, as amended.
 
Amending Zoning By-law No. 2010-068 pertains to an irregular shaped parcel of land located in proximity to the west end of Madeline Drive in the north west portion of Collingwood.  The parcel of land is legally described as Part of Lots 50 & 51 Concession 12 (former Township of Nottawasaga), now in the Town of Collingwood, County of Simcoe and is known municipally as 80 Madeline Drive.  The parcel of land is presently designated in the Town of Collingwood Official Plan, as amended, as Environmental Protection with a small portion as Rural Residential – Nine (note: the designations were established through a Ontario Municipal Board process). The land is presently zoned in the Town of Collingwood Zoning By-law Environmental Protection (EP) zone. 
 
THE PURPOSE AND EFFECT of the proposed Zoning By-law Amendment is to rezone the property from the Environmental Protection (EP) zone to the Rural Exception Eleven (RU-11) zone, the Environmental Protection Exception Twelve (EP-12) zone and the Environmental Protection Exception Thirteen (EP-13) zone.  The RU-11 zone proposes one (1) single detached dwelling with reduced setbacks and access via a private right-of-way to a public road.  Additional proposed uses include one (1) accessory storage building consisting of 325 square metres in floor area and private recreation uses.  The EP-12 zone is a restrictive EP zone which will limit uses to conservation, fish and wildlife management uses, an existing boat basin and channel, a boat slip, (not including a boathouse), in an existing boat basin and existing walking trails.  The EP-13 zone will limit uses to: conservation, walking trails, flood control works, a private road, a private dock, a boatslip, (not including a boathouse) a deck/patio and private recreational uses.
 
AND TAKE FURTHER NOTICEthat any person or agency may appeal the By-law by filing with the Clerk of the Corporation of the Town of Collingwood, not later than the 29th day of July, 2010, a notice of appeal on the requisite Ontario Municipal Board (OMB) Appeal Form setting out the objection to the By-law and the reasons in support of the objection, accompanied by the fee prescribed under the Ontario Municipal Board Act in the amount of $125.00 which must be in the form of a cheque payable to the Minister of Finance.
 
Only individuals, corporations and public bodies may appeal the Zoning By-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf.
 
No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submission at a public meeting or written submission to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.
