Reduce Speed Limit Within School Zones By-law

WHEREAS By-law 00-62, as amended designated certain highways as a Community Safety Zone;

 

AND WHEREAS Section 128 (5) of the Highway Traffic Act, R.S.O. 1990, chapter H.8, allows a municipality, by by-law, to designate the rate of speed within a portion of a highway under its jurisdiction that adjoins the entrance to or exit from a school and that is within 150 metres along the highway in either direction beyond the limits of the land used for the purposes of the school as a school zone; and for motor vehicles driven, on days on which school is regularly held, on the portion of a highway so designated, prescribe a rate of speed that is lower than the rate of speed otherwise prescribed under subsection (1) or (2) for that portion of highway, and prescribe the time or times at which the speed limit is effective;

 

AND WHEREAS By-law No. 2008-150 established reduced speed limits within a school zone on certain municipal highways;

 

AND WHEREAS the Council of the Corporation of the Town of Collingwood deems it necessary to amend By-law No. 2008-150 to include additional highways as described herein;

 

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF COLLINGWOOD HEREBY ENACTS AS FOLLOWS: 

 

THAT Section 2 of By-law No. 2008-150 be deleted and replaced with the following:

 

THAT the speed limit for motor vehicles travelling along a portion of highway described herein within 150 metres along the highway in either direction beyond the limits of the land used for the purposes of a school (school zone) be reduced to 40 kilometres per hour. 

 

2.   THAT signs be posted in a conspicuous place at each approach to the section of highway identifying the newly posted speed limit;

 

3.   THAT this By-law shall come into full force and effect on the date of final passage hereof at which time all By-laws and/or resolutions that are inconsistent with the provisions of this By-law and the same are hereby repealed or rescinded insofar as it is necessary to give effect to the provisions of this By-law.
