NOTICE OF APPLICATION FOR APPROVAL TO EXPROPRIATE LAND
Expropriation Act, R.S.O. 1990, c. E.26
IN THE MATTER OF an application by The Corporation of the Town of Collingwood for approval to expropriate land, being parts of the properties known municipally as 101, 295, and 260 Mountain Road, Collingwood, ON, for the purposes of road widening.
NOTICE IS HEREBY GIVEN that application has been made for approval to expropriate the lands described as follows:
1. Part of PT LOT 45 CON 10 NOTTAWASAGA AS IN RO216800 SAVE AND EXCEPT PART 3 ON 51R-21265 AND RO216798; COLLINGWOOD (part of PIN 58255-0393 (LT), Land Registry Office No. 51), shown as Part 1 on Reference Plan 51R-43338 (101 Mountain Road);
2. Part of PCL 45-4 SEC 51-NOTT-11; PT LT 45 CON 11 NOTTAWASAGA PT 1, 51R15871; COLLINGWOOD; (part of PIN 58255-0093 (LT), Land Registry Office No. 51), shown as Part 1 on Reference Plan 51R-43339 (295 Mountain Road); and
3. Part PT N 1/2 LT 44 CON 11 NOTTAWASAGA PTS 1 & 2 51R33006 EXCEPT PTS 1 & 2 51R33351; COLLINGWOOD (part of PIN 58254-0199 (LT), Land Registry Office No. 51), shown as Part 2 on Reference Plan 51R-43339 (260 Mountain Road).
Any owner of land in respect of which notice is given who desires an inquiry into whether the taking of such land is fair, sound, and reasonably necessary in the achievement of the objectives of the expropriating authority shall so notify the approving authority in writing,
(a) in the case of a registered owner, served personally or by registered mail within thirty (30) days after the registered owner is served with the notice, or, when the registered owner is served by publication, within thirty (30) days after the first publication of the notice;
(b) in the case of an owner who is not a registered owner, within thirty (30) days after the first publication of the notice.
