NOTICE - Temporary Noise Exemption

This notice is to confirm receipt of your request received on July 2, 2020 for an exemption under the Noise By-law, on behalf of Parkbridge Lifestyle Communities for the pouring on concrete at 70 Huron Street, Collingwood.

Section 4.1 of the Town of Collingwood Noise By-law No. 2018-032 states that:
“No person shall emit, cause or permit the emission of noise from any activity set out in Column 1 of Schedule “A” to this By-law except during the periods of time set out in Column 2 of Schedule “A”.” Item 2 in Schedule “A” permits the operation or use of any Construction Equipment in connection with a Site Alteration within an Active Development Monday to Friday between the hours of 7:00 AM to 7:00 PM.

Once an exemption request is received, the Clerk or CAO may grant an exemption from any of the provisions of the Noise By-law or, at their discretion, forward the exemption application to Council to have Council make the final decision on whether to grant or refuse the application, with or without conditions or to a greater or lesser extent.

In your request you have indicated the use of construction equipment that is required to be used outside of the permitted timeframe in order to complete the concrete work that you estimate to take a total of 16-20 hours and is dependent on temperature and chemicals within the concrete. The equipment that has been identified that will be used after 7:00 PM includes:

  • A gas power trowel machine with a Honda engine (9) HP. This machine will be used in the early to mid-stage of the concrete work, with hand tools used at the end-stage. The decibel readings for these machines is estimated at 50-60 decibels at close range from about 1-2m.

The intended date for the exemption to complete the concrete work that has been requested is:

  • July 9, 2020 at 7:00 PM through to July 10, 2020 at 6:00 AM

In reviewing this application it has been determined that the concrete work cannot be split into two days and is required to be a continual pour, and depending on conditions with respect to temperature and chemicals within the concrete, the concrete work may be completed as early as midnight. The applicant has agreed to make best efforts to minimize the noise created. Based on review of the information provided, the Town hereby grants a temporary noise exemption for the operation / use of Construction Equipment at the noted property. The conditions of the temporary noise exemption are as follows:

  1. The term of the temporary noise exemption is for: Thursday July 9, 2020 from 7:00 PM to Friday July 10, 2020 at 6:00 AM;
  2. Parkbridge Lifestyle Communities and Buttcon Limited will make every effort to reduce the level of noise produced by the construction equipment used to lessen the effect on the surrounding residents;
  3. Parkbridge Lifestyle Communities and Buttcon Limited shall advise the affected property owners of the reason for the construction activity outside of the hours prescribed in the Noise By-law through written notice. This notice is to be provided no later than July 6, 2020 and include contact information should anyone have questions or concerns to the work being undertaken. A copy of this notice shall be provided to the Town prior to being circulated to the affected residents, and is to include a list of addresses the notice is circulated to;
  4. The person who will be supervising the activity for which the exemption is being sought shall be available at all times to address any noise issues should complaints be received. Such persons have been noted in the application as:
  1. Should the noise generated by the concrete work cause hardship to the surrounding resident(s), the Town has the ability to revoke this exemption if deemed appropriate.

This temporary noise exemption will be provided to the Ontario Provincial Police (OPP) and Municipal By-law Enforcement Officers, and posted on the Town’s website indicating that a temporary noise exemption has been provided. Afterhours complaints can also be directed to:

Any breach of the terms or conditions of the exemption granted by the Town, or any error or omission in the information provided to the Town, shall immediately render the exemption null and void.
