Boulevard Encroachment Permit Request Form

*For the 2026 season, the following patio policies will apply on an interim basis while the Downtown Parking Study is underway and until parking impacts and recommendations for the downtown area are identified:

  1. Restaurants that were approved for on-street (parking space) patios on Hurontario Street in 2025 may be permitted to operate in 2026, provided that:
    • the patio operates a minimum of six (6) days per week; and
    • an equivalent number of replacement parking spaces are made available and approved by the CAO or the Director of Infrastructure.
  2. A restaurant may be permitted to obtain a Storefront Patio Permit if it was approved for a Storefront Patio Permit in 2025 or earlier.

No new permits will be issued for on-street (parking area) and storefront sidewalk patios in 2026.

Anyone wishing to use the municipal sidewalk and/or roadway to expand a patio or display merchandise available in a retail store is required to obtain a permit from the municipality prior to using the sidewalk and/or roadway for such purposes.

A permit is valid from the date of issue until October 15, or until such time as the Boulevard Encroachment By-law is repealed by Council, or as otherwise revoked or suspended, whichever is the earlier. The permit period for patios and curbside retail displays is May 1 through to October 15, with the start date contingent on weather forecasting and completion of spring maintenance and inspection of the sidewalks and roadways. Any business wishing to operate a patio outside of this timeframe is required to submit a new request form for a winter patio.

Additional conditions will apply to Boulevard Encroachment Permit holders that extend operations into the winter months and will be contained within the approved permit. The Town will not be held responsible for any damages that may result of the operation of a boulevard encroachment or from conducting winter maintenance. 

The use of portable heaters must meet the TSSA guidelines, and an inspection is required by Fire Services prior to their use.
