Take notice that the Town of Collingwood Council passed By-law No. 2024-008 on February 5, 2024 under Section 34 of the Planning Act.

map of 329 Third St.Location: 329 Third Street, Collingwood

Legal Description: Plan 73, Part Lots 28, 29, and 30 of Registered Plan 51R40341 (Part 1); Collingwood, County of Simcoe.

Area: 0.136 hectares

The subject property is located on the north side of Third Street, between Cedar Street and Walnut Street.

The purpose of the Zoning By-law Amendment is to rezone the subject lands from Residential Second Density (R2) to Holding Twenty-Six – Residential Second Density Exception Thirty-One [H26 (R2-31)] to permit the construction of a detached accessory building.

The effect of the R2-31 Zone is to permit a maximum of one (1) detached accessory building to be located closer to a front lot line than the closest exterior wall projection of the dwelling unit; increase the maximum ground floor area of one (1) detached accessory building to 111 m2; increase the maximum height of one (1) detached accessory building to 8.3 m; and increase the maximum gross floor area of one (1) accessory dwelling unit to 88 m2.

The effect of the H26 Zone is to prohibit additional habitable space on the property, including the establishment of an accessory dwelling unit, until a two-zone approach for the Oak Street Canal floodplain demonstrates that the property and/or proposed building envelope are within the flood fringe or outside of the hazard area, and confirmation from the Nottawasaga Valley Conservation Authority (NVCA) that a NVCA permit can be approved.

Public and Agency comments received: All written and oral submissions received in response to the application were considered in making an informed recommendation and decision as summarized in Staff Report P2024-02.
